WEBSITE TERMS OF USE

Paris Apartments Plus offers furnished apartments in Paris to rent for periods from three days to one year. We are not the owners of the apartments offered on our website. We partner with Paris based managers who provide and manage the apartments listed on our website on behalf of the apartment owners.

This notice is intended to inform you of and explain our terms and conditions for online, email, telephone and face to face communications whether you do or do not complete a booking of one or more of our apartments. To make this notice easy to find, we make it available from our main menu and footer of every page of our website.

Accessing, browsing and using this website and consequential email, telephone and face to face communications are subject to your irrevocable acceptance without modification of our terms and conditions and you agree to access, browse or use this website and communicate with us in accordance with these terms and conditions which include our privacy policy and our General Disclaimer.

If you do not read or accept these terms and conditions you should not use this website.

You confirm that you are of sufficient legal age to use this website and to create a binding legal and financial obligation for any liability you may incur as a result of the use of this website and communication with us by email or telephone.

Paris Apartments Plus reserves the right to amend these terms and conditions at any time as appropriate. It is the responsibility of those using this website and communicating with us to review these terms and conditions in case of a change since the last time of use.

When you book Paris apartment rentals direct, this notice also applies to all information specifically unrelated to but collected directly or indirectly from the Paris Apartments Plus website or consequent email, telephone or face to face communications. The types of information referred to in this instance include information about Paris, transport, weather, events, comments on Paris Apartments Plus BLOG, etc.

Paris Apartments Plus is not responsible for the accuracy of such information, errors or omissions, misrepresentation by or of information provided by third parties, content of external links on our website and any damage or loss as a result.

GENERAL DISCLAIMER

Paris Apartments Plus provides an online platform through which you can book Paris apartment rentals direct. By making a booking through Paris Apartments Plus and paying a deposit you enter into a Guest Reservation Agreement with Paris Apartments Plus and agree to enter into a direct, legally binding contractual relationship (rental agreement) with the apartment manager who represents the owner of the apartment. This rental agreement may vary between apartment managers and is signed on arrival.

The booking service provided by Paris Apartments Plus and the service provided by the apartment manager are separate services notwithstanding the fact that your combined deposit and balance payments equate to the total amount due for both services.

Subject to the limitations set out in the Guest Reservation Agreement we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect of our services under the Guest Reservation Agreement, up to an amount equating to the total amount paid (deposit or deposit and balance) for the period of your stay.

We shall not be liable for any punitive, special, indirect or consequential loss or damages, any loss of production, profit, revenue or contract, loss of or damage to goodwill or reputation or loss of claim as a result of a perceived or attributable shortfall in our services or information provided directly or indirectly through our website, emails, telephone calls or face to face communications.

Our Commitment to Privacy:

Paris Apartments Plus operates to high ethical standards and your privacy is important to us. To better protect your privacy we provide this notice explaining our online information practices. This notice and the policy it outlines is subject to our General Disclaimer.

The Information We Collect:

This notice applies to all information collected or submitted on the Paris Apartments Plus website. The types of information collected are:

- Name, Address, Email address, Phone number, Credit/Debit Card details, apartment testimonials and reviews, contributions to our Paris Apartments Plus blog, etc.

The Way We Use Information:

Save for disclosures required by law in any relevant jurisdiction, we use the information you provide when booking or enquiring about a furnished apartment in Paris only to process and complete the reservation and send updates. Other than with our apartment managers, we do not share this information with outside parties except to the extent necessary to complete that booking.

We use return email addresses to answer the email we receive and may, from time to time, request information or your opinion via a survey, send relevant information such as a Paris Apartments Plus newsletter or promotion. Such addresses are not used for any other purpose and are not shared with outside parties.

Together with our apartment manager partners, we might share non-identifying and aggregate information with our web designers or apartment owners to improve our website and enhance or vary our apartment offer, prices and service. These statistics never contain personally identifying information.

Once a request is made to Paris Apartments Plus, visitors will be able to access, via username and password, their own space on our website for information and records that we have collected and that we maintain about their enquiries and bookings on an ongoing basis. This is to simplify the administration of current and future bookings for you and Paris Apartments Plus.

Whilst we welcome and encourage you to provide apartment testimonials and reviews and comments to our blog, we reserve the right to add or remove blog contributions and apartment testimonials and reviews as we see fit.

Change or Removal of Information:

If your personal data or records on your space on Paris Apartments Plus are incorrect, we will change them upon your request by email. You can also ask us to remove your personal data from our database by sending us an email.

Change of Policy:

This Private Policy Statement is effective from April 1st 2014. We are at all times entitled to change the way we collect, transmit and process the personal information and such other information as we may deem necessary. This Privacy Policy Statement may therefore be amended from time to time in order to reflect the latest changes.

GUEST RESERVATION AGREEMENT

Guest Reservation Agreement with Paris Apartments Plus (“we” or “us”) to Supply Reservation Services to Guests

1. About Paris Apartments Plus and this Agreement

1.1 Paris Apartments Plus offers furnished apartments in Paris to rent for periods from three days to one year. We are not the owners of the apartments offered on our website. We partner with Paris based managers who provide and manage the apartments listed on our website on behalf of the apartment owners.

1.2 We do not have the authority to form a binding rental agreement between you and the apartment manager for the occupation of the apartment. At arrival time you will contract directly with the manager of the apartment under a rental agreement for the occupation of the apartment (see clause 3.2-3.3 below). You are required to enter into this Guest Reservation Agreement with us in order to make a booking and sign a rental agreement with the apartment manager. In this Guest Reservation Agreement you authorise us to confirm the booking on your behalf with the apartment manager and to hold and forward payments on your behalf for that purpose.

1.3 We are not a party to nor will we be liable in respect of any matter arising which relates to the rental agreement between you and the apartment manager.

2. Acceptance of terms and conditions of this Guest Reservation Agreement

2.1 The terms and conditions of this Guest Reservation Agreement are presented to you for acceptance immediately before you pay a booking deposit to confirm an apartment reservation. By accepting the terms and conditions you are then bound to this Guest Reservation Agreement and our General Disclaimer

3. Our Duties

3.1 In this Guest Reservation Agreement you instruct us to provide the following services to you:

3.2 We provide access to an online search and booking engine, used by us under contract from a third party provider, which lists the furnished apartments in Paris of a number of apartment managers we work with and with whom you will enter the rental agreement.

3.3 For illustrative purposes we show you an English version of the French rental agreement used by the manager supplying the majority of the apartments listed on our website. We also show you the French agreement but please be aware that there can be translation variations between the two and that the terms and conditions of rental agreements used by other managers of apartments on our website can also vary. 3.4 We will collect and process on your behalf the applicable cost for a booking you have made with an apartment manager through us. We act as a facilitator and having deducted our booking fee will pass the balance due to the apartment manager.

3.5 We agree to provide our services with the skill and care to be expected of an online booking facility. All other warranties and implied terms are excluded to the fullest extent permitted by law.

4. Reservation Confirmation

4.1 Your reservation will not be confirmed until we have received your deposit. You will then receive an email to confirm you reservation. The balance of the rental fee must be paid at least one month before the start of the rental period unless the booking is made within one month of the arrival date. We accept payment by credit card or direct transfer.

4.2 Once we confirm a booking to you and we have received the deposit or relevant payment, you will then have a binding booking for the apartment in accordance with this Guest Reservation Agreement and the rental agreement which you will be expected to sign on arrival at the apartment.

4.3 Under this Guest Reservation Agreement you irrevocably instruct us to process the funds for a booking as set out at 3.4 above and in accordance with our cancellation policy and the terms of the proposed rental agreement. Please note that in the event that you cancel a booking you irrevocably authorise us to deduct from the amount we are holding (or charge to any debit or credit card you provided at the time of your booking) the agreed cancellation charge and to remit the cancellation charge to the apartment manager. Each Guest Reservation Agreement represents a contract in respect of a given property on given dates. Any variation of the dates or accommodation, including without limitation, any reduction in the number of days of your booking will amount to a cancellation of a booking, unless we and the apartment manager agree otherwise.

5. Security Guarantee

5.1 Your credit card details must be provided when signing the rental agreement for our furnished apartments in Paris. This will authorize the debit of this card account in the event of damage caused to the apartment and/or the shared spaces in the apartment building. Funds are not blocked in advance and the cardholder’s account is only charged in the event of damage.

5.2 In the event of damage caused to the apartment, Paris Apartments Plus and/or the apartment manager will provide relevant documentation to justify the amount charged to your credit card within 30 days of the date of departure. If there is a problem and the card cannot be debited, you are expected to take the necessary measures to rectify the situation. 

5.3 Insurance cover for damages up to a value of EUR 2,500 (less an excess of €60) is included in the damage insurance cover provided with the apartment rental when the rental period is less than 90 days. If damage is caused to the apartment and it is covered by the insurance policy, the apartment manager will pursue recovery from the insurance company on receipt of written confirmation from you that you were responsible for the damage caused. You will be required to pay the excess of €60. If the damage caused is of a value greater than €2,500, you will be required to pay the difference in addition to the excess of €60. 6. Unavailability of our furnished apartments in Paris after booking or on arrival

6.1 If between the time of reservation and arrival, for reasons beyond our control, we deem it necessary to make the reserved apartment unavailable, Paris Apartments Plus and the apartment manager will make every effort to propose an alternative apartment.

Paris Apartments Plus and the apartment manager will refund the difference if the alternative apartment is accepted but is less expensive than the one originally reserved. Any reimbursement will be credited to the credit card used for the original payment.

6.2 When one of our furnished apartments in Paris is deemed unavailable, you may:

  • Accept our proposal of an alternative apartment.
  • Choose another apartment from our website (you must pay the extra cost if the rate for this apartment is more expensive).
  • Refuse any proposed alternative and decide not to select another apartment from our website.

6.3 If an alternative apartment is proposed by Paris Apartments Plus and rejected by you, or we are unable to propose one and you do not select an alternative from the website, you will be immediately reimbursed with all payments. Payments will be credited to the credit card used.

No other card may be credited with the reimbursement.

7. Presentation of our furnished apartments in Paris

7.1 Paris Apartments Plus advertises the apartments based on descriptions and photographs provided by the apartment manager on behalf of the apartment owner. Our aim is to provide a realistic impression of the apartments we offer for rent but we cannot be held responsible for any subsequent changes in decoration, furniture or contents made by a manager or owner.

7.2 In choosing an apartment as advertised by Paris Apartments Plus, you accept responsibility for your choice. If you is not satisfied with any aspect of an apartment upon arrival, Paris Apartments Plus and the apartment manager are not obliged to change anything or provide an alternative apartment.

8. Use of our furnished apartments in Paris

8.1 Rental agreements provide for private use only of an apartment, meaning that:

  • It is prohibited to use an apartment for professional purposes (company offices, events, shows, presentations, photo shoots, etc.).
  • Guests should avoid making unreasonable and excessive noise between 10pm and 8am.
  • The number of guests in an apartment must not exceed the capacity of that particular apartment as listed on the Paris Apartments Plus website
  • Pets are not allowed in the apartments unless you receive specific authorization from Paris Apartments Plus or the apartment manager

8.2 If guests and those accompanying them fail to comply with these conditions or demonstrate what is considered as inappropriate behavior, Paris Apartments Plus and the apartment manager reserve the right to ask them to vacate the apartment immediately with no refund.

9. Guest Services and products included in website price

9.1 Products and Services may vary with apartment manager but under the rental agreement you will have with the manager of the majority of apartments listed on our website, the following will be included

  • Utility costs (except for very exceptional use of electricity or gas)
  • Heating system, Refrigerator, Kitchen Utensils (delf, cutlery, glassware, pots & pans), Coffee maker, Kettle, Toaster, Hair dryer, Iron & ironing board and vacuum cleaner
  • Bed linen & towels for the maximum number of guests permitted in the apartment
  • Starter quantities of soap, toilet paper, dishwasher and washing machine products, laundry sacks and tissues
  • WiFi, cable TV (for most apartments)
  • Local and International Phone Calls free to many countries including US, CAN, AU, NZ etc in many apartments
  • Apartment damage insurance up to €2,500 
  • Personal Check-in
  • Check-out cleaning
  • Arrangement of our Partner Taxi Service on request
  • In-stay cleaning by request

10. Problems in the apartment or apartment building during your stay

10.1 Paris Apartments Plus and the apartment manager will make every effort to resolve problems that occur during a stay whether in the apartment or in any shared spaces in the apartment building. If we become aware in advance of any problems that will inhibit your enjoyment of your apartment, we will advise you accordingly. However we cannot be held responsible for any unforeseen difficulty that delays or prevents the resolution of an identified problem. Specifically, Paris Apartments Plus and the apartment manager are not responsible for: 

  • the malfunction of a lift/elevator in an apartment building.
  • any scaffolding or construction works which obstruct an apartment’s view.
  • any noise disturbances from neighbours or construction, cleaning or other service work in the apartment building or any adjoining building
  • any interruption of power, water, heating or any other utility services in an apartment.
  • the breakdown of any equipment in the apartment.
  • any interruption of wifi/internet, telephone or TV services.

These problems and ones of a similar nature are not considered as grounds for full or partial reimbursement of rent.

11. Problems with wifi/internet/TV/phone in the apartment during your stay

11.1 Paris Apartments Plus and the apartment manager will do whatever is possible to provide any direct assistance or information in connection with the breakdown of wifi/internet/TV/phone service in an apartment. Wifi, TV, phone and internet facilities in an apartment are reliant on third party service providers and while we will do our best to arrange a call out by the service provider if necessary, this can take a number of days which may or may not happen during your stay.

11.2 Wifi/internet/TV and phone services can be fragile / unreliable in older buildings in Paris so cannot be guaranteed by Paris Apartments Plus or the apartment manager. Wifi/internet/TV/phone problems are not considered as grounds for full or partial reimbursement of rent.

12. Guest Obligations and Responsibilities under the Guest Reservation Agreement

12.1 In order to allow us to provide the services set out in these terms and conditions you agree that you will:

  • provide us with complete, accurate and timely information to enable us to best provide the products and services listed above and co-operate fully with us in their provision;
  • be bound by the terms of the rental agreement entered into between you and the apartment manager;
  • irrevocably instruct us to process the payments for a booking with the apartment manager and instruct us to release those funds to the manager in accordance with our booking and cancellation terms.

13. Other Agreements and Disputes

13.1 In addition to the rental agreement, we are not a party to any other agreement between you and an apartment manager and will not be liable in respect of any matter whatsoever arising between you and the apartment manager under the rental agreement or any other agreement relating to the apartment.

13.2 In the event of any dispute whatsoever between you and the apartment manager in relation to occupation of an apartment you hereby release us from any and all liability in connection with such dispute and agree that we will not be liable or responsible in any way in respect of that dispute or to resolve that dispute.

14. General Obligations in Law

14.1 Each of the parties warrants its power to enter into this Guest Reservation Agreement and has obtained any necessary approvals to do so.

14.2 We will not be liable to you or be deemed to be in breach of these terms by reason of any delay in performing, or any failure to perform, any of our obligations if the delay or failure was due to any cause beyond our reasonable control such as severe weather, a natural disaster, strikes, governmental action, terrorism, war and civil unrest.

14.3 Each party acknowledges that this Guest Reservation Agreement (as varied) and the conditions contain the whole agreement between the parties and that it has not relied upon any oral or written representations made to it by the other or its employees or agents and has made its own independent investigations into all matters relevant to it.

14.4 This Guest Reservation Agreement shall be governed by Irish law in every particular including formation and interpretation and shall be deemed to have been made in Ireland.

14.5 Any proceedings arising out of or in connection with this Guest Reservation Agreement may be brought in any court of competent jurisdiction in Ireland.

14.6 Failure by either party to enforce at any time or for any period any one or more of the terms or conditions of this Guest Reservation Agreement shall not be a waiver of them or the right at any time subsequently to enforce all terms and conditions of this Guest Reservation Agreement.

CANCELLATION POLICY

Very early cancellation:

If you cancel more than two months prior to your due arrival date, your booking deposit will be refunded less a €75 administration fee.

Early cancellation:

If you cancel less than two months prior to your arrival, your booking deposit will not be refunded

Late cancellation:

If you cancel less than one month prior to your arrival, neither the booking deposit nor the balance if paid will be refunded

The sooner you cancel, the sooner we can make the apartment available for replacement bookings. The rent from a partial or complete replacement booking will be offset against rent not otherwise refunded.

What to do to cancel your booking:

Send us an email so that we can make the apartment available for other bookings as early as possible.

SPECIAL OFFERS AND THIRD PARTY SERVICES PARTNERS

Paris Apartments Plus regularly promotes special offers through our website. All special offers are subject to our general Paris Apartments Plus Terms and Conditions.

Paris Apartments Plus both partners with and refers customers to third party services providers in Paris.

We do not have the authority to form a binding service agreement between you and the third party service provider. You will contract directly with the third party service provider including where their service is packaged with an apartment booking with Paris Apartments Plus.
